Important: These Terms of Service govern your use of the UNIONE™ website, platform, and institutional services. By accessing any UNIONE™ service, you agree to be bound by these Terms. Arbitration proceedings are governed by the UNIONE™ Arbitration & Dispute Resolution Rules v3.0, which take precedence over these Terms in the event of any conflict relating to proceedings.
About UNIONE™
UNIONE™ - the UNIONE International Arbitration & Dispute Resolution System - is an international arbitration institution providing arbitration, dispute prevention, and dispute resolution services to parties engaged in cross-border commercial transactions.
UNIONE™ administers arbitration proceedings under its Rules, provides AI-powered tools for dispute prevention and management, maintains a curated global panel of arbitrators and neutrals, and offers institutional services including the Enforcement Readiness Review and Enforceability Certificate.
These Terms govern access to and use of the UNIONE™ website (theunione.org), the UNIONE™ case management platform, and all digital institutional services provided by UNIONE™.
Scope of Services
UNIONE™ provides the following categories of service, each subject to additional terms where applicable:
- Arbitration Administration: Administration of arbitration proceedings under the UNIONE™ Rules v3.0, including Tribunal constitution, case management, and the Enforcement Readiness Review.
- Dispute Prevention Services: Contract architecture review, Dispute Prevention Certificate issuance, Dispute Risk Assessment, and Standing Neutral services.
- AI Tools: The UNIONE™ AI tools suite, including the Clause Generator, Risk Analyser, Enforceability Predictor, Document Review Intelligence, and Hearing Intelligence.
- Panel Services: Maintenance of the UNIONE™ Fellows body, arbitrator appointment and vetting, and panel membership administration.
- Information Services: Publication of Rules, guidance, news, and institutional information on this website.
UNIONE™ does not provide legal advice. Nothing on this website or in any UNIONE™ institutional service constitutes legal advice, and no advisory relationship is created by accessing or using any UNIONE™ service.
Institutional Services - Arbitration
Arbitration proceedings administered by UNIONE™ are governed exclusively by the UNIONE™ Arbitration & Dispute Resolution Rules v3.0 in force at the date of commencement of the relevant arbitration. These Terms of Service do not form part of the arbitration agreement between parties and do not govern the conduct of arbitration proceedings.
UNIONE™'s institutional liability in connection with arbitration proceedings is limited in accordance with Article 64 of the Rules. Neither UNIONE™, its officers, employees, members of the Court, nor any arbitrator shall be liable to any Party for any act or omission in connection with an arbitration, except where such act or omission constitutes wilful misconduct or fraud.
The Enforcement Readiness Review and Enforceability Certificate are institutional services. They are not legal advice, do not constitute a guarantee of enforcement, and do not create any obligation on any court or enforcement authority.
AI Tools - Terms of Use
The UNIONE™ AI tools suite - including the Clause Generator, Risk Analyser, Enforceability Predictor, Document Review Intelligence, and Hearing Intelligence - is provided as an institutional service to support dispute prevention and resolution.
AI Tools Limitation: All AI tool outputs are provided for informational and decision-support purposes only. They do not constitute legal advice, and no advisory or professional relationship is created by using any AI tool. UNIONE™ makes no warranty as to the accuracy, completeness, or fitness for purpose of any AI tool output. Users should seek independent legal advice before relying on any AI tool output in legal proceedings or commercial decisions.
Documents uploaded to AI tools are processed in accordance with the UNIONE™ Data Protection Policy. No document content is retained beyond the processing session unless explicitly saved to a registered case file by the user.
By using any UNIONE™ AI tool, you confirm that you have the right to upload the documents and information you provide, and that you have obtained all necessary consents for the processing of any personal data contained in those documents.

Panel Membership
Membership of the UNIONE™ Fellows body is subject to the UNIONE™ Panel Membership Terms, the UNIONE™ Code of Conduct for Arbitrators and Neutrals, and the vetting and performance standards published by UNIONE™.
UNIONE™ reserves the right to remove any arbitrator or neutral from the Fellows body in accordance with the procedures set out in the Rules and the Panel Governance Framework, without liability to the removed member.
Listing in the UNIONE™ Fellows Directory does not constitute an endorsement, recommendation, or warranty by UNIONE™ in respect of any individual arbitrator's conduct, competence, or suitability for any particular dispute.
Fees & Payments
UNIONE™'s fees are set out in the UNIONE™ Schedule of Fees, published on this website and updated periodically. All fees are exclusive of applicable taxes unless stated otherwise.
The Cost-Certainty Pledge (Rules Article 52) applies to arbitration proceedings. UNIONE™ commits not to materially exceed the Cost-Certainty Estimate provided at registration by more than 20% without prior written notice and acknowledgement from the parties.
Fees paid to UNIONE™ are non-refundable except as set out in the Rules or the applicable Schedule of Fees.
Intellectual Property
The UNIONE™ name, marks, logo, and the designation "UNIONE™" are registered trademarks. All content on this website, including the UNIONE™ Rules, Guides, AI tool outputs, and institutional documents, is the intellectual property of UNIONE™ and is protected by applicable intellectual property law.
You may download and use UNIONE™ model clauses in your commercial contracts. You may share links to UNIONE™ publications. You may not reproduce, modify, distribute, or commercially exploit any UNIONE™ content without prior written permission.
UNIONE™ Rules v3.0 may be cited and referenced in legal proceedings, academic publications, and commercial contracts. Attribution to UNIONE™ is required.
Confidentiality
Arbitration proceedings administered by UNIONE™ are confidential in accordance with Rules Article 65. UNIONE™ will not disclose information about any case, party, or proceeding except as required by applicable law, by order of a competent court, or with the written consent of all parties.
Pre-dispute institutional services - including Dispute Risk Assessments, Dispute Prevention Certificates, and Dispute Risk Ratings - are strictly confidential. Their contents will not be disclosed to any third party without the express consent of the party that commissioned them.
AI tool processing is subject to the confidentiality commitments in the UNIONE™ Data Protection Policy.
Limitation of Liability
To the maximum extent permitted by applicable law, UNIONE™'s total aggregate liability to any user in connection with these Terms, this website, or any institutional service shall not exceed the fees paid by that user to UNIONE™ in the twelve months preceding the relevant claim.
UNIONE™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or business interruption, arising out of or in connection with the use of this website or any UNIONE™ service.
Nothing in these Terms excludes or limits UNIONE™'s liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.
Governing Law & Disputes
These Terms of Service are governed by and construed in accordance with the law of England and Wales, without regard to its conflict of law provisions.
Any dispute arising out of or in connection with these Terms - including any dispute as to their validity, interpretation, or performance - that cannot be resolved by negotiation shall be submitted to arbitration under the UNIONE™ Arbitration & Dispute Resolution Rules v3.0. The seat of arbitration shall be London (England & Wales). The language of the arbitration shall be English.
Amendments
UNIONE™ may amend these Terms at any time by publishing an updated version on this website. The date of last update is shown at the top of this page. Continued use of UNIONE™ services after an amendment constitutes acceptance of the updated Terms.
For registered users and parties to active arbitrations, material amendments to these Terms will be notified by email at least thirty (30) days before taking effect.
